I have an APC Battery Backup that I purchased. I have always been suspicious that it did not work. Three days ago, I unplugged everything attached to it and plugged in a night light. Even though the battery tested 12 volts, when I disconnected the APC Battery Backup from AC, the night light went off proving my suspicions.

Your service brochure states: Please DO NOT RETURN Back-UPS ES to the place of purchase under any circumstances. To me, this means that you do not want the retailers of your products to know what kind of junk you sell.

This is demand for refund of $129.23. When this amount is received, I will deliver the APC Battery Backup to a location or shipper of your choice that is within two miles distance. Until this amount is received, it will be held as evidence.

Unless this full amount is received by return mail, I shall file criminal fraud charges against all of the officers and directors of American Products Company and against you personally with authorities of the Federal Government and the State of Washington.

In addition, I shall file, on behalf of all purchasers who have likewise been defrauded, a class action, criminal conspiracy civil tort lawsuit under the RICO Act of 1970 (RACKETEER INFLUENCED AND CORRUPT ORGANIZATIONS ACT) against all of the officers and directors of American Products Company, their affiliated corporations, associated companies and subsidiaries.

This infringement forces me to use all remedies available, including the prerogatives given by the first amendment to the United States Constitution – the freedom of speech and press.
